What are the Penalties for Simple Possession of Marijuana in New Jersey?
While marijuana is still considered a Schedule I controlled dangerous substance (CDS) in New Jersey, the state has decriminalized the possession of small amounts of marijuana. This means that you face much less severe penalties for possession of marijuana than you do for other CDS.
If you are caught with less than 50 grams of marijuana, you face a civil penalty of up to $150. If caught with 50 grams or more of marijuana, you face a civil liability of up to $500.
If you are caught with less than 50 grams of marijuana in a school zone, you face a disorderly person's offense. This means you face up to six months in prison and up to $1,000 in fines. If caught with 50 grams or more of marijuana in a school zone, you face a fourth-degree crime. This is punishable by up to 18 months in prison and up to $25,000 in fines.
Possession of Heroin
Possession of heroin is considered a third-degree offense in New Jersey. This means you face up to five years in prison and up to $35,000 in fines if convicted of heroin possession. If you are caught with heroin in a school zone, you face up to 15 years in prison and up to $75,000 in fines.
Possession of Prescription Pills

If caught with a Schedule II CDS (such as Oxycontin or morphine) in a school zone, you face up to 18 months in prison and up to $25,000 in fines.
