  • Sexual penetration during the commission of another criminal act.
  • Sexual penetration when using a weapon.
  • Sexual penetration facilitated by another.
  • Sexual contact or penetration when the alleged victim is disabled or incapacitated.

Aggravated criminal sexual assault is classified as a first degree crime and a conviction could result in up to 20 years in prison. Criminal assault is a second degree felony and carries a 10-year prison sentence.

What Is Criminal Sexual Contact In New Jersey?

Criminal sexual contact in New Jersey is a fourth degree crime and includes intentional touching of a victim’s intimate parts for the purpose of humiliating or degrading the victim, or for the sexual arousal or gratification of the defendant. Aggravated criminal sexual contact is a third degree crime; the criteria are very similar to those that define aggravated sexual assault. A criminal sexual contact conviction carries a sentence of up to 18 months; an aggravated criminal sexual contact conviction could result in a sentence of up to five years.
