  • If the alleged victim is between 16 and 18 and the defendant is either related to the victim or is subject to control by the defendant (such as a prison inmate) in an incident of sexual penetration.
  • If the alleged victim is between one and 16 and the defendant is four years older in an incident of sexual penetration.

Other examples of sexual assault include sexual contact with an alleged victim under 13 when the defendant is over 17 or using non-injurious physical force to complete an act of sexual penetration.

Aggravated sexual assault can also be age related and include incidents such as:

  • Sexual penetration when the alleged victim is under 13 years old.
  • Sexual contact or penetration when the alleged an victim is between 13 and 16 and the defendant has control over them.
  • Sexual penetration during the commission of another criminal act.
  • Sexual penetration when using a weapon.
  • Sexual penetration facilitated by another.
  • Sexual contact or penetration when the alleged victim is disabled or incapacitated.

Aggravated criminal sexual assault is classified as a first degree crime and a conviction could result in up to 20 years in prison. Criminal assault is a second degree felony and carries a 10-year prison sentence.

What Is Criminal Sexual Contact In New Jersey?

Criminal sexual contact in New Jersey is a fourth degree crime and includes intentional touching of a victim’s intimate parts for the purpose of humiliating or degrading the victim, or for the sexual arousal or gratification of the defendant. Aggravated criminal sexual contact is a third degree crime; the criteria are very similar to those that define aggravated sexual assault. A criminal sexual contact conviction carries a sentence of up to 18 months; an aggravated criminal sexual contact conviction could result in a sentence of up to five years.
